What Happened?
The 2018 Farm Bill legalized hemp and hemp-derived products containing less than 0.3% delta-9 THC. Because this limit applied only to delta-9 THC measured before harvest, a loophole emerged:
• High-THCa hemp could be grown that tested below the legal delta-9 THC threshold.
• After harvest, THCa converts to intoxicating THC when heated (through smoking, vaping, or cooking).
• This created a market of intoxicating, unregulated hemp products that were never intended by the law.
Instead of targeting only these intoxicating products, a new federal spending bill proposes broad restrictions that could eliminate access to non-intoxicating CBD products as well.
What’s at Stake Right Now
The new proposal would:
• Cap hemp products at no more than 0.4 milligrams of total delta-9 THC per container
• Apply this limit to all hemp extracts, including full-spectrum CBD
• Trigger a nationwide loss of legal, non-intoxicating CBD products
• Strip access from seniors, veterans, families, and patients who rely on full-spectrum CBD for daily wellness
• Disrupt the livelihoods of hemp farmers and small businesses
This broad approach does not distinguish between intoxicating hemp derivatives and the therapeutic CBD products protected since 2018.
